SHIPPING AND RETURNS
1. Delivery of products and related costs

1.1 The products purchased will be delivered to the address indicated by the Customer in the Order within 12/17 working days + courier timeframe for shipment from acceptance of the Order by MB, at the cost specifically indicated on the Site prior to submission of the Order. MB reserves the right to accept or not deliveries requested outside the Italian or European borders. In any case, for deliveries to be carried out outside the Italian borders, shipping costs and delivery times may be subject to change.

1.2 With regard to requested deliveries to countries outside the European Union, any import customs charges will be borne by the recipient. The Customer is therefore encouraged to contact the customs authorities of their country in advance to verify the costs and any import limits.

1.3 The delivery times indicated by MB vary according to the product ordered (4 weeks + courier timeframe for the shipment of basic products, except for products that require a more complex realization, such as hand-painted garments or personalized prints) and a delay with respect to the same, or any delivery made with subsequent fractional shipments do not legitimize the Customer to the refusal of the delivery itself and to the request for compensation or compensation.

1.4 At the time of delivery of the products, the Customer is required to check:

That the number of packages in delivery corresponds to what is indicated in the transport document, that the packaging is intact, not damaged, wet or otherwise altered, even in the closing materials (adhesive tape or metal straps).
​
Any damage to the packaging and / or product or the mismatch of the number of packages or indications, must be immediately detected, affixing a specific indication on the delivery document of the product to be returned to the courier.
​
Any problems relating to the physical integrity, correspondence or completeness of the products received must be reported within 7 days of delivery, in the manner set out in this document.

2. Right of withdrawal
​
2.1 Pursuant to art. 52 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the Customer may withdraw from the Conditions and therefore from the purchase contract for any reason, without the need to give reasons and without any penalty, within 14 (fourteen) working days from the date of receipt of the products.

2.2 To exercise the right of withdrawal referred to in the previous article 2.1, the Customer must send MB a communication, within the terms indicated, to the following email address: martinabavarobrand@gmail.com, or use the appropriate form at the following link

2.3 In case of withdrawal, the Customer may resend at his own expense, the products to MB within 14 (fourteen) days of the same withdrawal, to the following address Martina Bavaro – Via Generale Schiaparelli n. 7 – 13897 Lower Eye (BI). The goods must be returned intact, complete with all its parts and in the original packaging (envelopes and packages), stored and possibly used for the time strictly necessary to establish and verify their nature, characteristics and size, according to normal diligence, without there being signs of wear or dirt, in compliance with the following conditions:

The right of withdrawal will not apply to products for which the customer has requested customization.
​
The right of withdrawal may apply to the product purchased in its entirety; in fact, it is not possible to exercise withdrawal only on part of the product purchased (eg: accessories, complements, etc.);
​
For the withdrawal to be possible, the product must be intact and returned in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: labels, tags, seals, etc...);
​
In case of damage to the goods during transport, MB will notify the Customer, to allow him to promptly file a complaint against the courier chosen by him and obtain the relative refund; the product will then be made available to the Customer, at the same time canceling the request for withdrawal;
​
MB will not be liable in any way for damage, theft, loss that occurred during or otherwise depending on the return shipment.

2.4 MB will reimburse the Customer for the full amount already paid, net of any additional shipping costs pursuant to Article 56, paragraph 2, of Legislative Decree 21/14), within 14 (fourteen) days from the withdrawal, by reversal procedure of the amount charged, using the same means of payment used by the Customer for the initial transaction, unless otherwise agreed. In any case, the Customer will not incur any costs as a result of such reimbursement. MB may suspend the refund until receipt of the returned product or until the Customer proves that he has correctly returned the product, whichever is earlier.

2.5 In any case, the Customer will forfee the right of withdrawal in cases where MB ascertains that:

The returned product and/or its accessories, and/or its packaging are not intact;
​
The product is missing in its original outer packaging and/or inner packaging;
​
The product is missing integral elements and/or accessories (ad. E.g. closures, laces, buckles, etc.).
​
In the event of forfeiture of the right of withdrawal, MB will return the purchased product to the sender, charging the same the shipping costs and if already refunded, the price of the product.
