1. Delivery of Products and Related Costs

1.1 The products purchased will be delivered to the address indicated by the Customer in the Order within 4–6 weeks from MB’s acceptance of the Order, at the cost specifically indicated on the Website before the Order is submitted. MB reserves the right to accept or reject delivery requests outside Italy or Europe. In any event, for deliveries to destinations outside Italy, shipping costs and delivery times may vary.

1.2 With regard to deliveries requested to countries outside the European Union, any import customs duties and charges shall be borne by the recipient. Customers are therefore advised to contact the customs authorities of their country in advance to verify the applicable costs and any import restrictions.

 

1.3 The delivery times indicated by MB vary depending on the product ordered (4–6 weeks, except for products requiring more complex production, such as hand-painted garments or customized prints). Any delay beyond the indicated delivery times, or any delivery made through subsequent partial shipments, shall not entitle the Customer to refuse delivery or to claim compensation or damages.

 

1.4 Upon delivery of the products, the Customer is required to check:

• That the number of packages being delivered corresponds to the number indicated on the transport document;

• That the packaging is intact, undamaged, dry and otherwise unaltered, including the sealing materials (adhesive tape or metal straps).

Any damage to the packaging and/or product, or any discrepancy in the number of packages or other details, must be immediately reported by entering a specific reservation on the delivery document to be returned to the courier.

Any issues concerning the physical integrity, conformity or completeness of the products received must be reported within 7 days of delivery, in accordance with the procedures set out in this document.

 

2. Right of Withdrawal

2.1 Pursuant to Article 52 of Legislative Decree No. 206/2005 (Italian Consumer Code), as amended by Legislative Decree No. 21/2014, the Customer may withdraw from these Terms and Conditions and, consequently, from the purchase contract for any reason, without having to provide any justification and without incurring any penalty, within 14 (fourteen) working days from the date of receipt of the products.

 

2.2 To exercise the right of withdrawal referred to in Article 2.1 above, the Customer must send MB a written notice within the applicable period to the following e-mail address: martinabavarobrand@gmail.com, or use the appropriate form available on the Website.

 

2.3 In the event of withdrawal, the Customer may return the products to MB at their own expense within 14 (fourteen) days from the date of withdrawal, to the following address:

The goods must be returned intact, complete with all their parts and in their original packaging (bags and packaging), and must have been handled and, where applicable, used only for the time strictly necessary to establish and verify their nature, characteristics and size, with due care and without any signs of wear or dirt, in compliance with the following conditions:

• Exclusions: The right of withdrawal shall not apply to products for which the Customer has requested customization.

• Integrity of the Product: The right of withdrawal applies to the purchased product in its entirety; withdrawal may not be exercised only in relation to part of the purchased product (e.g. accessories, complementary items, etc.).

• Packaging Conditions: In order for the right of withdrawal to be exercised, the product must be intact and returned in its original packaging, complete with all its parts (including the packaging and any documentation or accessories supplied, such as labels, tags, seals, etc.).

• Damage During Return Shipping: In the event that the goods are damaged during return shipping, MB shall notify the Customer so that the Customer may promptly file a claim with the courier selected by the Customer and obtain the relevant reimbursement. The product shall then be made available to the Customer, and the withdrawal request shall be deemed cancelled.

• Liability: MB shall in no event be liable for any damage, theft or loss occurring during or otherwise in connection with the return shipment.

 

2.4 MB shall refund the Customer the full amount already paid (excluding any additional shipping costs pursuant to Article 56, paragraph 2, of Legislative Decree No. 21/2014) within 14 (fourteen) days from the date of withdrawal, by reversing the amount charged, using the same payment method used by the Customer for the original transaction, unless otherwise agreed. In any event, the Customer shall not incur any costs as a result of such refund. MB may withhold the refund until the returned product has been received, or until the Customer provides evidence that the product has been correctly returned, whichever occurs first.

 

2.5 In any event, the Customer shall lose the right of withdrawal if MB determines that:

• The returned product and/or its accessories and/or packaging are not intact;

• The product is missing its outer packaging and/or original inner packaging;

• The product is missing any integral parts and/or accessories (e.g. fasteners, laces, buckles, etc.).

In the event that the right of withdrawal is forfeited, MB shall return the purchased product to the sender, charging the Customer for the shipping costs and, where the purchase price has already been refunded, the price of the product.
